Punjab & Haryana High Court Allows Sale of Nicotine Replacement Therapy in Retail Outlets

In a landmark decision, the Punjab and Haryana High Court has permitted the sale of Nicotine Replacement Therapy (NRT) products in retail outlets.

This ruling recognizes the effectiveness of NRT in helping individuals quit smoking and highlights its inclusion in the National List of Essential Medicines, underscoring its importance in public health initiatives.

The court's decision reflects a substantial shift in perspective regarding NRT Dr Chandrakant S Pandav, a Padma Shree Awardee and former head of Community Medicine at AIIMS, New Delhi, praised the ruling.

He stated, "Understandably, NRT stands as a safe and effective aid for smokers looking to quit, and this ruling now rightly acknowledges that fact. NRT plays a vital role in providing the necessary support to quitters, allowing individuals to gradually reduce their nicotine intake and achieve a smoke-free life - a goal many smokers aspire to. Of late, the lifting of the ban and its easy availability will be a boost to quitting smoking."

Enhanced Accessibility & Public Health Impact

Dr Niranjan Naik, director of Onco-Surgery at Fortis Memorial Research Institute (FMRI), Gurgaon, emphasized the decision's potential to transform public health.

According to him, the HC’s decision is a game-changer as it paves the way for making NRT more accessible. NRT is a safe and effective tool, widely recognized as the most effective form of quitting tobacco aid.

‘’By allowing its wider availability, we can empower millions of smokers who genuinely want to quit but struggle with withdrawal symptoms. Enhanced availability of NRT can greatly improve public health outcomes, leading to a healthier future for our communities. Its availability at retail outlets will help people head toward tobacco cessation," Dr Naik remarked.

The court's decision also marks the removal of NRT from the Poisons Act of 1919, a critical turning point in smoking cessation efforts. This shift allows NRT products to be sold in retail outlets, thereby recognizing their value and increasing accessibility.

This move is expected to empower more individuals to quit smoking, ultimately saving lives and promoting a healthier future for the population.

Types & Benefits of NRT

NRT products come in various forms, including gums, patches, inhalers, and mints. According to the World Health Organization (WHO), over one million people in India die from smoking-related illnesses each year.

NRT can play a significant role in reducing this number by providing controlled doses of nicotine to ease the quitting process. Each type of NRT offers specific advantages:

- Gums: Release nicotine gradually, helping to manage cravings over time.

- Patches: Provide sustained nicotine release throughout the day, aiding in continuous craving management.

- Inhalers: Simulate the act of smoking, providing immediate relief and addressing both physical and psychological aspects of addiction.

- Mints: Dissolve in the mouth and address cravings discreetly, although their effects may take longer to manifest compared to other forms.

The inclusion of NRT in the National List of Essential Medicines in 2022 underscores its critical role in public health strategies aimed at reducing tobacco use.
