Fortis Healthcare Acquires Fortis Trademark for INR 200 Cr via Auction

Fortis Healthcare has acquired the Fortis trademark through a public auction for INR 200 Cr. 

The sale was conducted following a directive from the Hon'ble Delhi High Court, which had ordered it in accordance with a previous Supreme Court judgment.

According to Fortis Healthcare’s regulatory filing, the Fortis Marks were previously held by entities owned and controlled by the company’s erstwhile promoters. These trademarks were attached and made available to the court to satisfy a decree in favour of Daiichi Sankyo Company Limited.

Legal Proceedings and Acquisition

The sale of the Fortis trademarks and associated marks was initiated under a Delhi High Court order dated October 29, 2024. The order was a direct consequence of a Supreme Court judgment dated September 22, 2022, which had directed the auction process.

Following the legal directive, a public auction was conducted, where Fortis Healthcare emerged as the successful bidder with a INR 200 Cr offer.

"By way of its judgment dated March 25, 2025, the Hon'ble Delhi High Court has confirmed the sale of the Fortis Marks and all attendant rights and liabilities in favour of the company pursuant to the public auction process," Fortis Healthcare stated in its regulatory filing.

Implications of the Trademark Acquisition

With the acquisition, Fortis Healthcare secures full ownership of the Fortis Marks, ensuring brand continuity under its control. The transaction resolves the longstanding legal entanglements involving the trademarks previously linked to the company’s former promoters.

This move follows Daiichi Sankyo’s legal battle over financial disputes with Fortis’ former promoters, leading to the court-mandated auction process. By confirming the sale, the Delhi High Court has legally transferred all rights and liabilities related to the Fortis Marks to the healthcare provider.
